These Terms and Conditions ("Terms") govern your access to and use of the website located at www.kana-pt.com (the "Site"), operated by KANA PHYSICAL THERAPY WELLNESS PLLC ("KANA," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. No Medical Advice / No Provider-Patient Relationship — The Site is provided for general informational purposes about KANA's services and staff. Nothing on the Site constitutes medical advice, diagnosis, or treatment, and no physical therapist-patient relationship is created by browsing the Site, submitting a contact form, or booking a consultation. A provider-patient relationship, and the duties that come with it, begins only once you have completed intake, consent, and evaluation processes directly with our clinical staff. Always seek the advice of a qualified healthcare provider with questions regarding a medical condition, and never disregard professional medical advice or delay seeking it because of something you read on the Site. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.
2. Use of the Site — You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to: Use the Site in any way that violates applicable federal, state, or local law; Attempt to gain unauthorized access to any portion of the Site or its related systems; Interfere with or disrupt the operation of the Site; Use any automated system (e.g., bots, scrapers) to access the Site without our prior written consent; Submit false, misleading, or fraudulent information through any form on the Site.
3. Scheduling Consultations — The Site allows you to request or book consultations through Calendly, a third-party scheduling platform. Your use of Calendly is subject to Calendly's own terms of service and privacy policy, which are governed by their own terms and policies, in addition to these Terms. We are not responsible for the availability, functionality, or performance of third-party scheduling tools. Cancellation, rescheduling, and no-show policies for appointments are governed separately by our office policies, which will be communicated to you at or before your first appointment.
4. Intellectual Property — All content on the Site — including text, graphics, logos, images, and the KANA name and branding — is the property of KANA or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and print content from the Site for your own personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.
5. Third-Party Links — The Site may contain links to third-party websites or services (such as Calendly) that are not owned or controlled by KANA. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. Your use of such third-party sites is at your own risk.
6. Employment Applications — If you submit an application through the "Join Our Team" section of the Site, you represent that the information you provide is accurate and complete. Submitting an application does not guarantee an interview, offer, or position with KANA.
7. Disclaimer of Warranties — THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability — TO THE FULLEST EXTENT PERMITTED BY LAW, KANA AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS IS INTENDED TO LIMIT LIABILITY FOR PROFESSIONAL NEGLIGENCE IN THE ACTUAL PROVISION OF PHYSICAL THERAPY SERVICES, WHICH IS GOVERNED BY SEPARATE CONSENT-TO-TREATMENT DOCUMENTATION AND APPLICABLE NEW YORK LAW.
9. Indemnification — You agree to indemnify and hold harmless KANA, its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
10. Governing Law and Venue — These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Westchester County, New York, and you consent to the personal jurisdiction of those courts.
11. Changes to These Terms — We may revise these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
12. Severability — If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
