Privacy Policy

KANA Physical Therapy & Wellness, KANA PHYSICAL THERAPY WELLNESS PLLC ("KANA," "we," "us," or "our") operates the website located at www.kana-pt.com (the "Site"). This Privacy Policy explains how we collect, use, disclose, and safeguard information we receive through the Site.

Important note about health information: This Policy describes our practices for information collected through the Site itself (such as when you fill out a contact form or request a consultation). It does not cover Protected Health Information ("PHI") we create or receive as part of providing physical therapy services once you become a patient. That information is governed by our HIPAA Notice of Privacy Practices, which is provided separately at intake and is available upon request. If anything in this Policy appears to conflict with our HIPAA Notice of Privacy Practices regarding your health records, the HIPAA Notice controls.

1. Information We Collect

A. Information You Provide to Us — When you use the Site, we may collect information you voluntarily provide, such as: Name, email address, and phone number (e.g., through a contact form, "Book a Call" link, or job application under "Join Our Team"); Information you submit in connection with scheduling a consultation (note: consultations are booked through Calendly, a third-party scheduling service — see Section 4 below); Any other information you choose to include in messages to us.

B. Information Collected Automatically — Like most websites, our Site (which is hosted on the Wix platform) automatically collects certain technical information when you visit, which may include your IP address, browser type, device information, pages visited, and approximate location derived from IP address. This is typically collected through cookies or similar technologies placed by our hosting provider (Wix) that are necessary for the Site to function (e.g., load balancing, security). As of this Policy's effective date, we do not have our own analytics or advertising tracking pixels (such as Google Analytics or Meta Pixel) installed on the Site; if that changes, we will update this Policy.

C. Information We Do Not Collect Through the Site — We do not use the Site itself to collect medical history, symptoms, diagnoses, or other health information. If you complete any intake or health history forms, those are handled outside the Site (e.g., in person, through a secure patient portal, or via your electronic medical record) and are covered by our HIPAA Notice of Privacy Practices.

2. How We Use Your Information — We use the information described above to: Respond to inquiries and requests for consultations; Schedule, confirm, and manage appointments; Send appointment reminders, administrative updates, and (where you've agreed) marketing communications; Process job applications submitted through the Site; Maintain, secure, and improve the Site; Comply with applicable law and enforce our Terms and Conditions.

3. Marketing Communications (Email & Text/SMS) — If you provide your email address or phone number and opt in, we may send you marketing emails and/or text messages (e.g., promotions, newsletters, wellness tips, appointment-related texts). Email: Every marketing email will include a clear way to unsubscribe, consistent with the federal CAN-SPAM Act. You can also unsubscribe by contacting us directly (see Section 10). Text/SMS: By opting in, you consent to receive recurring automated text messages from us at the number provided. Message and data rates may apply, and message frequency may vary. You may reply STOP at any time to opt out of text messages, and HELP for assistance. We will not sell or share your mobile opt-in information with third parties for their own marketing purposes. Consent to receive texts is not a condition of purchasing any service. You may opt out of marketing communications at any time without affecting our ability to send you non-marketing, service-related communications (e.g., appointment confirmations) where applicable.

4. Third-Party Services — Our Site links to or integrates with third-party services that have their own privacy practices, including: Calendly (appointment scheduling) — information you enter to book a consultation is submitted directly to Calendly and governed by Calendly's Privacy Policy. Wix.com (website hosting/platform) — governed by Wix's Privacy Policy.

5. How We Share Information — We do not sell your personal information. We may share information with: Service providers who perform functions on our behalf (e.g., website hosting, scheduling, email/SMS delivery platforms), under obligations to protect your information; Legal and safety purposes, if required by law, subpoena, or court order, or to protect the rights, property, or safety of KANA, our patients, or others; Business transfers, if we are involved in a merger, acquisition, or sale of assets (you will be notified of any change in ownership or use of your information).

6. Data Security — We maintain reasonable administrative, technical, and physical safeguards designed to protect the personal information of New York residents that we collect, consistent with New York's Stop Hacks and Improve Electronic Data Security Act (SHIELD Act). No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

7. Data Retention — We retain personal information collected through the Site for as long as reasonably necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements.

8. Your Choices and Rights — Marketing opt-out: See Section 3. Access/correction: You may contact us to request access to, or correction of, personal information you've submitted through the Site. Do Not Track: Our Site does not currently respond to "Do Not Track" browser signals. New York does not currently have a comprehensive consumer data privacy statute comparable to California's CCPA. If that changes, or if you are a resident of a state with applicable privacy rights, we will honor requests as required by law — contact us using the information in Section 10.

9. Children's Privacy — The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site. If you believe a child has provided us information, please contact us so we can delete it.
